Terms of Service

1. Acceptance

These Terms of Service ("Terms") form a binding agreement between you and settlesoal.ai, operated by SETTLESOALAI ENTERPRISE ("SettleSoal", "we", "us"). By creating an account, downloading the app, or otherwise using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. The service

settlesoal.ai is a study aid for Malaysian secondary school students preparing for SPM. The current service includes:

• Snapping a photo of a homework or exam question and receiving up to two similar past-year SPM questions, each with a marking-scheme-formatted solution
• Browsing our curated bank of past-year SPM questions by subject and topic (the "Topics" revision feature) and reading their full marking-scheme solutions — subject to a daily limit on the number of solutions you can open, which varies by plan
• Optionally escalating to an AI Tutor (powered by Google Vertex AI Gemini) for a step-by-step explanation, both from a snapped question and from a topic's worked solution
• For Pro users, requesting a live human tutor session for additional 1-on-1 help, and a "Recently Viewed" history of topic questions you have opened

Subjects supported at launch: Mathematics, Additional Mathematics, Physics, Chemistry, and Biology (5 STEM subjects). We may add, change, or remove features at our discretion; significant changes will be announced in-app.

3. Eligibility & accounts

• You must be at least 16 years old to create an account. If you are under 18, you confirm that you have permission from a parent or legal guardian to use the service.
• You agree to provide accurate information (name, school, form level, email) and to keep your account credentials secure.
• You are responsible for all activity that occurs under your account.
• One person, one account. Sharing accounts or reselling access is not permitted.

Paid subscriptions must be purchased by the payment account holder or with the payment account holder's permission.

4. Subscriptions, billing, and cancellation

4.1 Plans (Malaysian Ringgit)

4.2 Auto-renewal

Plus and Pro plans are billed monthly and auto-renew at the same price until cancelled. You can cancel at any time:

• Android: open Google Play → Subscriptions → settlesoal.ai → Cancel. Cancellation takes effect at the end of the current billing period.
• Web: web subscriptions are not available unless they are explicitly offered on our website. If web subscriptions are later launched, the applicable payment provider and cancellation flow will be disclosed before purchase.

4.3 Refunds

• Android (Google Play): refund requests are handled by Google Play under its policies. We honour Google's decisions.
• Web payments: if web subscriptions are later launched, the refund process will be disclosed before purchase.
• Partial-month refunds for change-of-mind cancellations are not provided, except where required by applicable law or platform policy.

Nothing in these Terms limits any non-excludable rights you may have under Malaysian consumer protection law or applicable app-store rules.

4.4 Price changes

We may change subscription prices with at least 30 days' notice via email and in-app banner. New prices apply to your next renewal after the notice period.

5. AI Tutor — important disclaimers

• The AI Tutor is a study aid, not a substitute for a qualified teacher, tutor, or the official SPM marking scheme.
• AI-generated explanations may contain mistakes, especially in BM-language problems or non-standard notation. Always verify with a trusted source.
• You are responsible for your own academic integrity. Do not submit AI-generated content as your own work in any examination or assignment where doing so would violate your school's or examination board's rules.
• We log AI prompts and responses for safety review, quality improvement, and the moderation purposes described in our Privacy Policy.

6. Live tutor sessions (Pro plan)

• Pro includes 10 live tutor questions per 30-day cycle. Unused questions do not roll over.
• A "question" is one accepted tutor session. We do our best to match you with a qualified tutor within 15 minutes; if no tutor accepts, the quota is refunded.
• Tutor sessions are subject to a code of conduct: respectful communication, no exchange of personal contact details, no attempt to take the conversation off-platform, no sharing of copyrighted material in bulk. We reserve the right to suspend accounts that violate this.

7. Acceptable use

You agree not to:

• Use settlesoal.ai during a live, invigilated examination
• Upload images that contain other people's private information, faces, identity documents, sexual content, hate speech, or content that infringes copyright in a manner not permitted by Malaysian fair-dealing rules
• Attempt to reverse-engineer the service, bypass plan quotas, scrape the corpus, or interfere with other users
• Use the service to build a competing dataset or to train other AI models
• Resell, sublicense, or commercially redistribute access to the service

8. Content rights

• Your content: you retain ownership of the photos and questions you submit. By submitting them, you grant SettleSoal a non-exclusive, royalty-free, worldwide licence to process them for the purpose of providing and improving the service (as described in our Privacy Policy).
• Our content: the SettleSoal app, brand, corpus of past-year questions and solutions, and software are owned by SettleSoal or our licensors. You may use them only as part of normal use of the service.
• Past-year questions: SPM past-year exam questions are the property of their respective rights-holders, which may include Lembaga Peperiksaan Malaysia or state/examination bodies. We use them for educational reference under fair-dealing principles. If you are a rights-holder and believe we have used material improperly, contact support@settlesoalai.com for our takedown process.

Our takedown process will require enough information to identify the material, verify your authority to act for the rights-holder, and contact you about the request. We will review properly submitted notices promptly and may remove or disable access to disputed material while we investigate.

9. Suspension and termination

We may suspend or terminate your account if you materially breach these Terms or use the service in a way that puts other users, our staff, or our infrastructure at risk. Any refund or continuation of paid access after suspension will be handled in accordance with applicable law, platform policies, and the seriousness of the breach. You may close your account at any time from the profile screen or by emailing us; see the Privacy Policy for our deletion timeline.

10. Disclaimers and limitation of liability

SettleSoal is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, error-free, or that retrieved questions or AI explanations will be accurate or sufficient for any particular examination outcome.

To the maximum extent permitted by Malaysian law, our total liability to you for any claim arising out of or relating to the service is limited to the amount you paid us for the service in the 6 months preceding the event giving rise to the claim, or RM 100, whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages, including lost grades, scholarship outcomes, or examination results. Nothing in these Terms excludes or restricts liability where it would be unlawful to do so.

11. Indemnity

You agree to indemnify SettleSoal against claims arising from your misuse of the service or your breach of these Terms or applicable law.

12. Governing law and disputes

These Terms are governed by the laws of Malaysia. The courts of Kuala Lumpur have exclusive jurisdiction over any dispute, save that we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property. Before bringing any formal claim, you agree to first contact us at support@settlesoalai.com and attempt good-faith resolution for 30 days.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-app and by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance. If you do not agree to the updated Terms, you may cancel your subscription and close your account.
